Terms of Service

These Terms of Service apply to the following iOS apps published by Debug Till Done LLC:

By downloading or using any of these apps, you agree to these Terms and our Privacy Policy, which is incorporated into these Terms by reference.

1. Use of the apps

These apps are provided for personal, non-commercial use. You agree to use them only for their intended purposes and in compliance with all applicable laws and regulations.

2. No warranties

The apps are provided "as is" without warranties of any kind, express or implied. Debug Till Done LLC makes no warranty that the apps will be uninterrupted, error-free, or free of harmful components.

Easy Elevation Tracker is intended for general outdoor activity use only. It is not designed or intended for use in safety-critical situations. Do not rely on altitude or GPS data from Easy Elevation Tracker for navigation, emergency response, or any situation where inaccurate data could result in injury or harm.

See Me (at night) is a visibility aid only. It is not a substitute for proper safety equipment, lighting, or precautions. Debug Till Done LLC makes no warranty regarding its effectiveness in any specific situation.

3. Limitation of liability

To the maximum extent permitted by applicable law, Debug Till Done LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the apps, even if Debug Till Done LLC has been advised of the possibility of such damages.

In no event shall Debug Till Done LLC's total liability to you for any claim arising from or related to the apps exceed the amount you paid for the applicable app in the twelve months preceding the claim, or five dollars ($5.00), whichever is greater.

4. Indemnification

You agree to indemnify, defend, and hold harmless Debug Till Done LLC and its members, officers, agents, and successors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use or misuse of any app; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.

5. Intellectual property

All content, design, code, and assets within the apps are the property of Debug Till Done LLC and are protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without express written permission.

6. Third-party services

FitnUS Goals integrates with Apple Health and iCloud. Easy Elevation Tracker integrates with Apple Location Services. Your use of these services is governed by Apple's Terms of Service and Privacy Policy. Debug Till Done LLC is not responsible for the practices of Apple or any other third party.

7. Termination

Debug Till Done LLC reserves the right to discontinue any app or update its functionality at any time. Upon discontinuation of an app, any data stored solely within that app on your device will remain on your device until you delete the app. Data stored in Apple's ecosystem (iCloud, HealthKit) is governed by Apple's terms and remains subject to Apple's data practices. These Terms remain in effect for as long as you use the apps.

8. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the state or federal courts located in California, and you consent to personal jurisdiction in those courts.

9. Entire agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Debug Till Done LLC regarding the apps and supersede any prior or contemporaneous agreements, representations, or understandings, whether written or oral.

10. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

11. Changes to these terms

If these Terms change materially, the updated version will be posted at this URL with a revised effective date. Material changes take effect thirty (30) days after posting. Your continued use of the apps after that period constitutes acceptance of the updated Terms. Changes required by law may take effect immediately.
